The Legal Framework
Age-restricted communities in the United States are governed by the Housing for Older Persons Act (HOPA), which creates an exemption to the Fair Housing Act's prohibition on age discrimination. To qualify as a 55+ community under HOPA:
- •At least 80% of occupied units must have at least one resident who is 55 or older
- •The community must publish and follow policies demonstrating intent to be 55+ housing
- •The community must maintain age verification procedures
The 80% rule means that up to 20% of units can be occupied by residents under 55 — so you may have younger neighbors in a 55+ community. This is normal and legal.

- •Airports: Southwest Florida International (RSW) in Fort Myers serves most of the region. Naples Airport (APF) has limited commercial service. If you plan to travel frequently or have family flying in, proximity to RSW is a practical consideration.
- •Beaches: Gulf Coast beaches are the region's crown jewel. Some communities are a short drive from the beach; others are 45–60 minutes inland.
Community Size and Culture
Larger communities (1,000+ homes) offer more amenities and more social programming but can feel impersonal. Smaller communities (200–500 homes) often have a tighter-knit culture but fewer amenities.
Visit the community at different times — a weekday morning and a weekend afternoon — to get a sense of the actual activity level and the people who live there. Talk to residents, not just the sales staff.
